If Florida has the power to divide the pension, the Florida court will first determine the percentage of the length of the marriage is to the total time of military service. This is the marital portion of the pension. In other circumstances, points accumulated during reserve duty or in other ways may be included to determine the marital portion of a pension. The spouse is often entitled to receive one-half of the marital portion of the military pension. Spouses usually are not entitled to receive any portion of disability payments that are paid instead of military retirement pension.
