What is a "Return Hearing?"

Because the other side did not know about your request for an Injunction, the Court will hold a hearing so that the other side may tell the Judge that person’s side. The Return Hearing is usually held within 15 days of the date you obtained the Injunction. At the Hearing, you may have to tell the Judge why you want the Injunction. You should state all of the reasons that you are in fear of a person. You should list the last violent incident first. Be detailed and clear about all incidences of violence or the threat of violence. At the return hearing, the Court will either dismiss (cancel) the Injunction or set a Final Injunction for a period of time. The Final Injunction may include contact with the children and child support.
