Driving Under the Influence of an intoxicating medication, which may include alcohol, some medications, and illegal drugs. You do not have to be “drunk” or impaired to be convicted of being under the influence. If you have a breath test or blood alcohol test that shows your reading at .08 or higher, you are presumed to be under the influence. The police officer may also use observations, or physical tests to gauge your ability to stand, talk, reason or function.
