What is the procedure for probate?

Generally speaking, for summary or family administration, we file a Petition and the Court issues an Order approving the administration. Your probate is then completed! If a formal administration is required, we file a Petition and a copy of the Will if there is a Will, the Court appoints your Personal Representative (who is selected by you, if you have a Will), and the Personal Representative makes sure any debts are paid and your assets are distributed. When all of the assets are distributed, the Personal Representative will obtain an Order from the Court approving the distribution of the assets and closing the probate.
