The Serviceperson’s Civil Relief Act provides protection for active duty servicepersons who cannot attend court because of military deployment and commitments. A case may be abated (placed on hold) if the service person is not available, and will resume when the serviceperson is available. In most cases, a default cannot be entered. However, if the serviceperson is available for court, even if on active duty, the case will not be delayed.
